Office of Commissioner of Baseball.pdf To put this into perspective for non law nerds, granting summary judgement requires that no reasonable jury could find for the "non movant" that is the party not making the motion, which here is Hernandez. That itself is a fairly high bar, but is not unusual to be met. However, to meet that burden when it turns on intent is incredibly difficult because that isn't something that can't generally be proven directly so there is always a possibility they jury can believe someone or not.
