If you are asking the ref to make a judgement on intent and how much more or less aggressive the hit could have been, that is a really bad road to go down. I think that's exactly what the rules currently asks. LIS I know WHY it was called (both because of Barr and the makeup for two missed PI calls) but that play should not be an actual penalty is my point.
